DownloadThe following owner of the property listed below (“Owner”) hereby submits this application to receive one (1) to two (2) trees between the sidewalk and curb in front of their house or within six feet (6’) of the curb in front of their house. The location, number, and species of tree(s) to be planted in front of the house will be by mutual agreement of the Owner and Trees for Harmony, Inc. (“TFH”). After installation of the tree(s), TFH may also place signs(s) of an aggregate of no more than ___ square inches in the area where the tree(s) are planted identifying the tree(s) as provided in connection with TFH and/or containing identifying information about the tree(s) species.
TFH will cover the purchase and delivery cost of the tree(s) to be placed on or adjacent to the front of the lot. Any costs of planting the tree(s) will be paid by TFH. TFH will pay for any signs.
In exchange for receipt of the tree(s) to be purchased and planted under the conditions noted above, the Owner acknowledges and agrees that, for so long as they own the lot described below:
1. Owner will contact Arizona 811 ("Blue Stake") to create a ticket at least two full business days (excluding weekends and state-recognized holidays) prior to the scheduled dig (planting) date. Arizona 811 will mark underground utilities on Owner's property in the area to be planted. This must be done before Trees for Harmony will dig and plant trees.
2. Owner will permit TFH agents and representatives on Owner’s lot for the purpose of planting, watering (as set forth below), and inspecting the tree(s) and for replacing any signage.
3. Owner will maintain and care for the health of the tree(s) (watering, feeding, trimming, pruning, spraying, etc.). Once a tree is planted, the Owner becomes fully responsible for the care of the tree(s).
4. Owner will keep the tree(s) trimmed so the tree(s) a) do not impede pedestrian traffic on the sidewalk, b) comply with the City of Phoenix overhead clearance requirements for trash removal vehicles, and c) do not cause any traffic sight visibility hazards.
5. Owner will not cut down or remove the tree(s) unless it becomes necessary due to disease or death of the tree(s).
6. Owner agrees to hold TFH harmless for all liability arising out of or associated with the tree(s) planted by TFH. This includes, but is not limited to, damage to persons and/or property caused by the tree(s).
